These Terms apply to your use of studiomarketingco.com.au, including its forms, booking pages and online checkout. By using the website, you agree to these Terms.

1. Website Information

The website provides general information about Studio Marketing Co and its services. We aim to keep information accurate and current, but you should confirm important pricing, package and service details directly with SMC before relying on them.

Nothing on the website is legal, accounting, tax, financial or regulatory advice.


2. Our Services

SMC provides CRM access and implementation, websites, automations, workflows, funnels, forms, calendars, integrations, hosting, support and related services.

The DIY plan may be purchased or trialled online. Done-For-You and Growth+ services require a call or chat so SMC can assess the requested scope, suitability and capacity before accepting the engagement.

SMC may approve, decline or propose changes to a requested project where reasonably necessary.


3. Client Agreements

These Terms govern use of the website. Trials, subscriptions and client services are separately governed by the SMC Client Legal Suite, the relevant Plan Schedule, any Trial Terms, the Acceptable Use Policy, Refund and Cancellation Policy, and any signed proposal or service schedule.

Clients must accept the applicable client documents before a trial begins or paid work starts. A signed proposal or service schedule overrides the general terms only where it clearly states a different term.


4. DIY Trial and Signup

Customers may choose a 14-day DIY free trial or begin the paid DIY plan immediately. No payment details are required for the free trial and it does not convert automatically.

Trial access ends after 14 days unless the customer actively chooses to continue. SMC will normally contact a new DIY customer within 24 business hours after signup or cleared payment.

Phone numbers, calls, SMS, email sending and other usage-based services are not included in the free trial and remain the customer's responsibility.


5. Pricing, Payment and Usage Charges

Prices are in Australian dollars unless stated otherwise.

SMC is not currently registered for GST. If GST later applies, displayed consumer prices will remain GST-inclusive unless clearly stated otherwise.

Invoices are generally payable within five working days of the invoice date.

Third-party subscriptions, usage charges, integrations, phone services, SMS and email sending may be billed separately.


6. Cancellations and Refunds

Cancellations and refunds are handled under the SMC Client Legal Suite and Refund and Cancellation Policy.

Monthly subscription refunds are generally calculated daily from the effective cancellation date.

Applicable onboarding-fee refunds are generally calculated on a time-based pro-rata basis during the first 30 days after payment.

Usage charges, consumed credits, bank fees and third-party costs are generally non-refundable.

Nothing in these Terms removes rights or remedies that cannot legally be excluded.


7. Acceptable Website Use

You must not:

Use the website unlawfully

Attempt unauthorised access

Introduce malware

Interfere with its operation

Submit fraudulent or misleading information

Harass another person

Copy protected content without permission

SMC may restrict access where reasonably necessary to protect its systems, clients or users.


8. Accounts and Security

Where an account is provided, you are responsible for:

Keeping login details secure

Controlling access given to employees and contractors

Notifying SMC promptly of suspected unauthorised access

You are responsible for activities performed by people you authorise to use your account.


9. Intellectual Property

Unless otherwise stated, SMC owns or licenses the website branding, written content, graphics, designs, templates, software, workflows, systems, layouts and other materials.

You may use the website for ordinary evaluation of SMC services but must not reproduce, resell, modify, distribute or commercially exploit SMC content without written permission.

Client and third-party trade marks, logos and materials remain the property of their respective owners.


10. Third-Party Services

SMC services may rely on:

Hosting providers

Domain registrars

Telecommunications providers

Email providers

Payment processors

Google

Meta

Other integrations

SMC does not control third-party services and cannot guarantee their continuous availability, approval processes, security or performance.

SMC will use reasonable efforts to assist with relevant issues but is not responsible for failures outside its reasonable control.


11. No Guaranteed Results

SMC does not guarantee any particular:

Revenue

Leads

Sales

Customers

Rankings

Conversion rates

Business growth

Operational outcome

Results depend on the client's circumstances, participation, market, offer, conduct and other factors outside SMC's control.


12. Liability

To the maximum extent permitted by law, SMC is not liable for indirect or consequential loss, including:

Lost profits

Lost revenue

Lost opportunities

Reputational damage

Business interruption

Where liability may lawfully be limited, SMC's total liability will generally not exceed the fees paid by the affected client during the three months immediately before the event giving rise to the claim.

These limits do not exclude liability or consumer rights that cannot legally be excluded.


13. Privacy and Cookies

Our handling of personal information is explained in our Privacy Policy.

The website may use essential cookies and, where accepted, optional analytics, advertising and tracking technologies.


14. Changes

SMC may update these Terms by publishing a revised version online.

Material changes affecting active clients will be communicated where reasonably required.

Changes to active client service agreements or pricing generally require at least 30 days' notice.


15. Governing Law

These Terms are governed by the laws of Queensland, Australia.

The parties submit to the courts of Queensland, with Brisbane being the preferred location for proceedings where appropriate.
